A 15-year-old girl accused of brutally beating her classmate Kaylee Gain into a coma will not be charged as an adult, a judge ruled on Wednesday. A St. Louis judge ruled the case will remain in juvenile court after reviewing the unidentified suspect’s history in school and finding evidence that Gain was a bully.
The judge also reportedly met with the suspect and her family multiple times after the vicious fight occurred at Hazelwood East High School on March 8. Gain awoke from her coma several days later, but her family said she will be in recovery for a long time. Greg Smith, Gain’s attorney, said in court this week that the teen had struck the 15-year-old suspect first. Smith argued that while Gain had been previously suspended from school for a fight, she had a stable home life, performed well in school, and behaved well in juvenile detention center.
